As the settler state of Canada expanded into Indigenous lands, two traditions clashed in a bruising series of asymmetrical encounters over land use and ownership. One site of conflict was Kahnawà:ke. "Justin B. Richland continues his study of the relationship between American law and government and Native American law and tribal governance in his new manuscript Cooperation without Submission: Indigenous Jurisdictions in Native Nation-US Engagements. Richland looks at the way Native Americans and government officials talk about their relationship and seek to resolve conflicts over the extent of Native American authority in tribal lands when it conflicts with federal law and policy. The American federal government is supposed to engage in meaningful consultations with the tribes about issues that affect the tribes under long standing Federal law which accorded the federal government the responsibility of a trustee to the tribes. It requires the government to act in the best interest of the tribes and to interpret agreements with tribes in a way that respects their rights and interests. At least partly based on a patronizing view of Native Americans, the law has also sought to protect the interests of the tribes from those who might take advantage of them. In Cooperation without Submission, Richland looks closely at the language employed by both sides in consultations between tribes and government agencies focusing on the Hopi tribe but also discussing other cases. Richland shows how tribes conduct these meetings using language that demonstrates their commitment to nation-to-nation interdependency, while federal agents appear to approach these consultations with the assumption that federal law is supreme and ultimately authoritative"– Provided by publisher.

This book corrects the tendency in scholarly work to leave Indigenous peoples on the margins of discussions of environmental inequality, by situating them as central activists in struggles to achieve environmental justice. Drawing from archival and interview data, it examines and compares the historical and contemporary processes through which Indigenous fishing rights have been negotiated in the United States, Australia and New Zealand, where three unique patterns have emerged and persist. It thus reveals the agential dynamics and the structural constraints that have resulted in varying degrees of success for Indigenous communities who are struggling to define the terms of their rights to access traditionally harvested fisheries, while also gaining economic stability through commercial fishing enterprises. "Political theorists often imagine themselves as political architects, asking what an ideal set of laws or social structures might look like. Yet persistent injustices can endure for decades or even centuries, despite such ideal theorizing. In circumstances of this kind, it is essential for political theorists to think carefully about the political choices available to those who directly face such injustices, and seek to change them. This book focuses on the claims of Aboriginal peoples to better treatment from the United States and Canada. Though other groups face similarly persistent injustices (e.g. African Americans in the United States), the specific details of injustice matter a great deal for its analysis. The book focuses on two intertwined issues: the kinds of moral permissions that those facing persistent injustice have when they act politically and the kinds of transformations that political action may bring about in those who undertake it. Strategies of Justice argues for normative permissions to speak untruth to power, to circumvent or nullify existing law, to give primary attention to protecting one’s own community first, and to engage in political experimentation that reshapes future generations. The book argues that, when carefully used, these permissions may help political actors to avoid co-optation and self-delusion. At the same time, divisions of labor between those who grapple most closely with state institutions and those who keep their distance may be necessary to facilitate escape from persistent injustice over the long term"
