This book brings together Indigenous, Third World and Settler perspectives on the theory and practice of decolonizing law. Colonialism, imperialism, and settler colonialism continue to affect the lives of racialized communities and Indigenous Peoples around the world. Law, in its many iterations, has played an active role in the dispossession and disenfranchisement of colonized peoples. Law and its various institutions are the means by which colonial, imperial, and settler colonial programs and policies continue to be reinforced and sustained. There are, however, recent and historical examples in which law has played a significant role in dismantling colonial and imperial structures set up during the process of colonization. This book combines usually distinct Indigenous, Third World and Settler perspectives in order to take up the effort of decolonizing law: both in practice and in the concern to distance and to liberate the foundational theories of legal knowledge and academic engagement from the manifestations of colonialism, imperialism and settler colonialism. As the settler state of Canada expanded into Indigenous lands, two traditions clashed in a bruising series of asymmetrical encounters over land use and ownership. One site of conflict was Kahnawà:ke. This book explores Native American literary responses to biomedical discourses and biomedicalization processes as they circulate in social and cultural contexts. Native American communities resist reductivism of biomedicine that excludes indigenous (and non-Western) epistemologies and instead draw attention to how illness, healing, treatment, and genetic research are socially constructed and dependent on inherently racialist thinking. This volume highlights how interventions into the hegemony of biomedicine are vigorously addressed in Native American literature. The chapters cover tuberculosis and diabetes epidemics, the emergence of Native American DNA, discoveries in biotechnology and the problematics of a biomedical model of psychiatry. They analyze work by writers including Louise Erdrich, Sherman Alexie and LeAnne Howe, Kim TallBear, Linda Hogan, Heid Erdrich, Elissa Washuta, and Frances Washburn. The book will appeal to scholars of Native American and Indigenous Studies, as well as to others with an interest in literature and medicine

When Leopold Pospíšil first arrived in New Guinea in 1954 to investigate the legal systems of the local tribes, he was warned about the Kapauku, who reputedly had no laws. Skeptical of the idea that any society could exist without laws, Pospíšil decided to live among and study them. He quickly discovered that the supposedly "Stone Age" Kapauku possessed laws, rules and social structures that were often more sophisticated and rational than those in the West.

"Justin B. Richland continues his study of the relationship between American law and government and Native American law and tribal governance in his new manuscript Cooperation without Submission: Indigenous Jurisdictions in Native Nation-US Engagements. Richland looks at the way Native Americans and government officials talk about their relationship and seek to resolve conflicts over the extent of Native American authority in tribal lands when it conflicts with federal law and policy. The American federal government is supposed to engage in meaningful consultations with the tribes about issues that affect the tribes under long standing Federal law which accorded the federal government the responsibility of a trustee to the tribes. It requires the government to act in the best interest of the tribes and to interpret agreements with tribes in a way that respects their rights and interests. At least partly based on a patronizing view of Native Americans, the law has also sought to protect the interests of the tribes from those who might take advantage of them. In Cooperation without Submission, Richland looks closely at the language employed by both sides in consultations between tribes and government agencies focusing on the Hopi tribe but also discussing other cases. Richland shows how tribes conduct these meetings using language that demonstrates their commitment to nation-to-nation interdependency, while federal agents appear to approach these consultations with the assumption that federal law is supreme and ultimately authoritative"– Provided by publisher.

"Conversations with LeAnne Howe is the first collection of interviews with the groundbreaking Choctaw author, whose genre-bending works take place in the US Southeast, Oklahoma, and beyond our national borders to bring Native American characters and themes to the global stage. Best known for her American Book Award-winning novel Shell Shaker (2001), LeAnne Howe (b. 1951) is also a poet, playwright, screenwriter, essayist, theorist, and humorist. She has held numerous honors including a Fulbright Distinguished Scholarship in Amman, Jordan, from 2010 to 2011, and she was the recipient of the Modern Language Association’s first Prize for Studies in Native American Literatures, Cultures, and Languages for her travelogue, Choctalking on Other Realities (2013). Spanning the period from 2002 to 2020, the interviews in this collection delve deeply into Howe’s poetics, her innovative critical methodology of tribalography, her personal history, and her position on subjects ranging from the Lone Ranger to Native American mascots. Two previously unpublished interviews, "‘An American in New York’: LeAnne Howe" (2019) and "Genre-Sliding on Stage with LeAnne Howe" (2020), explore unexamined areas of her personal history and how it impacted her creative work, including childhood trauma and her incubation as a playwright in the 1980s.
